SC Opinion on Conducting Remains to 209 + Interviewed Candidates
As far as this submission is concerned it is not possible to
accept this for the reason that accepting the submissions of Mr. Salve and
Ms. Mahalakshmi Pavani to restrict the fresh examination to 209 candidates
only, will mean that 209 candidates will answer one set of question papers
whereas those who had passed the main examination on the earlier occasion,
had answered another set of question papers. This will not withstand
scrutiny of Article 14 of the Constitution of India, since two sets of
candidates will be tested on the basis of two different sets of examination
papers. It is ultimately their ranking in the main examination which is
going to be relevant. Therefore, the main examination has to be a common
examination for all those who are now held to be eligible on the basis of
their passing the preliminary examination. This being so, the submission
cannot be accepted.

నిజానికి నిరుడు ఉమ్మడి రాష్ట్రంలో జరిగిన వీఆర్వో, వీఆర్ఎ, పంచాయతీ సెక్రటరీ పోస్టులను తప్పిస్తే... గత మూణ్ణాలులేళ్లుగా ఉమ్మడి రాష్ట్రంలో ఏపీపీఎస్సీ ద్వారా ప్రకటనలు వెలువడలేదు. గ్రూప్-1, గ్రూప్-2 పరీక్షలు చివరగా 2011లో జరిగాయి. అందులోనూ గ్రూప్-1 పరీక్ష సుప్రీంకోర్టు ఆదేశాల కారణంగా రద్దయింది. పంచాయతీ ఎన్నికలకు ముందు కిరణ్కుమార్రెడ్డి ప్రభుత్వం సుమారు 50 వేలకుపైగా పోస్టుల ప్రకటనలకు అనుమతినిచ్చిందని వార్తలొచ్చాయి. కానీ కార్యరూపం దాల్చలేదు. కొత్త రాష్ట్రం తెలంగాణలోనైనా తమ ఆశలు తీరుతాయని విద్యార్థులు, నిరుద్యోగులు ఎదురుచూస్తున్నారు. అయితే ఎన్ని ప్రభుత్వోద్యోగాలు ఖాళీగా ఉన్నాయనే అంశంపై ఇంకా స్పష్టత లేదు. రాష్ట్ర విభజన సమయంలో ఏపీపీఎస్సీ తీసిన లెక్కల ప్రకారం సుమారు రెండురాష్ట్రాలకు కలిపి 40 వేల ఖాళీలున్నట్లు గుర్తించారు. వీటిలో 18 వేల పోస్టుల దాకా తెలంగాణకు చెందుతాయని అంచనా! అయితే... తాజాగా రాష్ట్ర ఆర్థికశాఖ లెక్కల ప్రకారం... తెలంగాణ రాష్ట్రంలో లక్షా ఏడువేల పోస్టులు ఖాళీగా ఉన్నట్లు తేలింది. అంతేగాకుండా... కమల్నాథన్ కమిటీ మార్గదర్శకాలు అమల్లోకి వచ్చి ప్రస్తుత ఉద్యోగుల విభజన, కేటాయింపులు పూర్తయితేగాని ఈ లెక్క కచ్చితంగా ఎంతనే దానిపై స్పష్టత వస్తుందని భావిస్తున్నారు. రాష్ట్ర ప్రభుత్వం తాజాగా కాంట్రాక్టు ఉద్యోగుల సేవల్ని క్రమబద్ధీకరించాలని నిర్ణయించిన నేపథ్యంలో... ఖాళీల సంఖ్యలో మార్పు రావొచ్చు. వీటికి అదనంగా ఉపాధ్యాయుల పోస్టుల కోసం వేలమంది ఎదురు చూస్తున్నారు.

The Government is keen to fill up vacant posts under various categories in the

inevitability of bifurcation of Andhra Pradesh and consequent fall out shrinking
opportunities to the educated un-employee youth in the Andhra Pradesh. The
opportunities that existed before the bifurcation of combined AP were lost after the
bifurcation of the State. Hence the proposal to enhance the age limit from 34 years
to 40 years became urgent need of the hour. Accordingly, the following adhoc rule is
issued raising the upper age limit of 34 years prescribed in Rule 12 of the Andhra
Pradesh State and Subordinate Service Rules, 1996, by six years for the
recruitments.
3. The following notification will be published in the Andhra Pradesh Gazette.
ADHOC RULE
Notwithstanding anything contained in the Andhra Pradesh State and Subordinate
Service Rules or in the Special or Adhoc Rules for any State and Subordinate
Service, the maximum age limit prescribed in the said rules for appointment by direct
recruitment shall be raised by “Six Years” i.e., from 34 to 40 years for the purpose of
direct recruitment to the various categories of posts to be notified from the issuance
of this GO and up to 30.09.2016 by all the recruiting agencies in the State of
Andhra Pradesh. The age concession over and above the Upper Age Limit shall also
be allowed to the categories as provided under Rule 12 of the Andhra Pradesh State
and Subordinate Service Rules, 1996.
Provided that nothing in this rule shall apply for direct recruitment to the
posts of uniformed services of Police, Excise, Fire, Prisons and Forest departments for
which physical standards have been prescribed in the State and Subordinate Service
Rules or in the relevant special or adhoc rules.

ఈనాడు, హైదరాబాద్: నిరుద్యోగులకు తీపి కబురు. ఆంధ్రప్రదేశ్ ప్రభుత్వం ఉద్యోగ నియామక గరిష్ఠ వయోపరిమితిని ఏకంగా ఆరేళ్లు పెంచింది. ఆంధ్రప్రదేశ్ పబ్లిక్ సర్వీస్ కమిషన్తోపాటు రాష్ట్రంలోని ఇతర నియామక సంస్థల ద్వారా జరిపే నియామకాలన్నింటికీ గరిష్ఠ వయో పరిమితిని 34 నుంచి 40 ఏళ్లకు పెంచింది. ఈ సడలింపు 2016 సెప్టెంబర్ 30 వరకు అమల్లో ఉంటుంది. ఈ మేరకు రాష్ట్ర ప్రభుత్వ ప్రధాన కార్యదర్శి ఐవైఆర్ కృష్ణారావు సెప్టెంబరు 23న జీవో నెంబర్ 295 విడుదల చేశారు. రాష్ట్ర విభజన అనంతరం విద్యావంతులైన నిరుద్యోగులకు అవకాశాలు తగ్గిపోయినందున వయోపరిమితి పెంపు అనివార్యమైందని జీవోలో పేర్కొన్నారు. ఒకేసారి వయోపరిమితిని ఆరేళ్లు పెంచడం గతంలో ఎన్నడూ జరగలేదు. ''ఆంధ్రప్రదేశ్లోని వివిధ విభాగాల్లో ఉన్న ఖాళీ పోస్టులను భర్తీ చేయాలని ప్రభుత్వం భావిస్తోంది. దాని ప్రకారం ఉద్యోగ నియామక సంస్థలు ఎప్పటికప్పుడు ఖాళీలను నోటిఫై చేస్తున్నాయి. చాలా విరామం తర్వాత నేరుగా నియామకాలు చేపడుతున్నారు. ఆంధ్రప్రదేశ్ విభజన కారణంగా నిరుద్యోగులకు అవకాశాలు కుంచించుకు పోయాయి. ఈ నేపథ్యంలో గరిష్ఠ వయోపరిమితిని పెంచడం అనివార్యమైంది అని జీవోలో పేర్కొన్నారు. ఈ మేరకు రాష్ట్ర ప్రభుత్వం సబార్డినేట్ రూల్స్లో తాత్కాలిక నిబంధన చేరుస్తోంది. ఆంధ్రప్రదేశ్లోని అన్ని నియామక సంస్థలు జీవో విడుదల నాటి నుంచి 2016 సెప్టెంబర్ 30వ తేదీ వరకు జారీచేసే నోటిఫికేషన్లు అన్నింటికీ ఈ సడలింపు వర్తిస్తుంది. వయో పరిమితి సడలింపు పోలీసు నియామకాలకు వర్తించదని జీవోలో పేర్కొన్నారు. యూనిఫామ్ సర్వీసులైన పోలీసు, ఎక్సైజ్, అగ్నిమాపకదళం, అటవీశాఖల నియామకాలకు దేహ ధార్డయ ప్రమాణాలు తప్పనిసరి అయినందున తాజా సడలింపు వాటికి అమలు కాదని స్పష్టం చేసింది.
తక్షణం నోటిఫికేషన్లు విడుదల చేస్తేనే ఉపయోగం
ఖాళీగా ఉన్న పోస్టుల భర్తీకి తక్షణం నోటిఫికేషన్లు విడుదల చేస్తేనే నిరుద్యోగులకు మేలు జరుగుతుందని ఉద్యోగ సంఘాలు పేర్కొన్నాయి. ఇప్పటికే పదవీ విరమణ వయస్సును 60 ఏళ్లకు పెంచడంతో పాటు నియామక గరిష్ఠ వయోపరిమితిని 40 ఏళ్లకు పెంచడంవల్ల ప్రభుత్వం రెండు వర్గాలకూ న్యాయం చేసినట్లయిందని వ్యాఖ్యానించాయి. రాష్ట్రంలో లక్షకు పైగా ఉద్యోగాలు ఖాళీ ఉన్నాయని, వాటన్నింటికీ దశల వారీగా నోటిఫికేషన్ జారీచేసి నియామకం చేపడితే వయోపరిమితి సడలింపు నిరుద్యోగులకు వరం అవుతుందని అన్నాయి.

ఈనాడు, హైదరాబాద్: తెలంగాణ రాష్ట్ర పబ్లిక్ సర్వీసు కమిషన్ (టీఎస్పీఎస్సీ) ప్రారంభంపై ప్రతిష్టంభన నెలకొంది. కమిషన్ ఏర్పాటు కోసం ఉత్తర్వులిచ్చి నెలన్నర దాటినా ఇప్పటివరకు కార్యకలాపాలను చేపట్టలేదు. దీనికి సంబంధించిన కార్యాచరణపై ముఖ్యమంత్రి కేసీఆర్ ఆదేశాల కోసం అధికారులు ఎదురుచూస్తున్నారు. టీఎస్పీఎస్సీ ఏర్పాటుపై ఎన్నికల్లో హామీ ఇచ్చిన ప్రభుత్వం ఆగస్టు 8వ తేదీన కమిషన్ ఏర్పాటుకు ఉత్తర్వులు జారీ చేసింది. కమిషన్ ఏర్పాటు జూన్ రెండు నుంచే వర్తిస్తుందని, వెంటనే కార్యకలాపాలు నిర్వహించాలని ఆదేశించింది. ఈ మేరకు సీఎస్ నేతృత్వంలోని కమిటీ.. టీఎస్పీఎస్సీ విభజన, విధివిధానాలు, పాలకమండలి స్వరూపంపై దస్త్రాన్ని రూపొందించి ఆగస్టు మూడో వారంలో ప్రభుత్వానికి పంపింది. దీని ప్రకారం ఏపీపీఎస్సీని విభజించి, తెలంగాణ పబ్లిక్ సర్వీసు కమిషన్కు గదులు కేటాయించాలి. ఉద్యోగులను విభజించి, తెలంగాణ ఉద్యోగులను టీఎస్పీఎస్సీకి బదలాయించాలి. ఏపీ ప్రభుత్వంతో చర్చించి ఈ రెండు నిర్ణయాలు తీసుకోవాలి. మరోవైపు కమిషన్కు కార్యదర్శిని, నామినేటెడ్ పాలకమండలిని నియమించి వెంటనే కార్యకలాపాలను ప్రారంభించాలి. ఈ ప్రక్రియలేమీ ఇప్పటివరకు జరగలేదు. పాలకమండలి నియామకం తేలాకే మిగిలిన నిర్ణయాలు తీసుకోవాలని ముఖ్యమంత్రి భావిస్తున్నట్లు తెలిసింది. పాలకమండలిలో స్థానం కోసం భారీ సంఖ్యలో దరఖాస్తులు వచ్చాయి. దీంతో సీఎం నిర్ణయం కోసం అందరూ నిరీక్షిస్తున్నారు. పబ్లిక్ సర్వీసు కమిషన్ ద్వారా 50 వేల ఉద్యోగ నియామకాలు చేపడతామని స్వాతంత్య్ర దినోత్సవాన సీఎం ప్రకటించారు. కమిషన్ ప్రారంభమయ్యాకే ఈ ప్రక్రియ ప్రారంభమవుతుంది.ఉద్యోగుల పదోన్నతుల పరీక్షలూ కమిషన్ ద్వారానే జరగాలి. ఏపీలో శాఖాపరమైన పరీక్షలు యథాతథంగా జరుగుతుండగా.. తెలంగాణలో వీటి నిర్వహణ నిలిచిపోయింది. ఈ నేపథ్యంలో టీఎస్పీఎస్సీ ఏర్పాటు ప్రక్రియను వెంటనే చేపట్టాలని తెలంగాణ ఉద్యోగుల సంక్షేమ సంఘం అధ్యక్షుడు జి.వెంకటేశ్వర్లు గురువారం ముఖ్యమంత్రి కేసీఆర్ను అభ్యర్థించారు. వెంటనే కార్యకలాపాలు చేపట్టేలా ఆదేశాలివ్వాలని కోరారు.

ఈనాడు-హైదరాబాద్: ఆంధ్రప్రదేశ్ పబ్లిక్ సర్వీస్ కమిషన్ అధ్యక్షుడు చిత్తరంజన్ బిశ్వాల్ పదవీకాలం ముగిసింది. పదవీకాలం అధికారికంగా నవంబరు 2 (ఆదివారం)తో ముగియాల్సి ఉండగా సెలవు దినం కావడంతో ఒకటో తేదీనే ఆయన పదవి నుంచి వైదొలిగారు. పదవీకాలం ముగిసినట్లు సాధారణ పరిపాలనశాఖ నవంబరు 1న ఉత్తర్వులు జారీచేసింది. 2012 డిసెంబరు 28వ తేదీన అధ్యక్షుడుగా బిశ్వాల్ పదవీ బాధ్యతలు స్వీకరించారు. ప్రస్తుతం ఉన్న నలుగురు కమిషనర్లలో ఒకరిని ఇంఛార్జి ఛైర్మన్గా నియమించనున్నారు. ఉద్యోగ ప్రకటనల జారీ లేనందున ఏపీపీఎస్సీ ప్రాధాన్యం తగ్గింది.

Is it good news or bad news that the case has been converted to curative petition, only GOD knows. What twists will we see further? Depends on the govt of both sides. By the way we are seeing regarding the conduct of simple academic Intermediate exams and Eamcet, these govts are fighting like small children in a gully cricket match.The argument that this is case between a constituonal body and the judiciary also will not matter much if the respective govts do not find a common ground to conduct the exam or to accomodate the merit list, whichever of them happens.

Fate of APPSC candidates of 2012 still hangs in balance.
For the 606 candidates who got through the rigorous process of prelims, mains and the interview stage in the Andhra Pradesh Public Service Commission (APPSC) Group-I examination in 2012, it has not only been the longest wait but also a frustrating one. Their fate still hangs on the Supreme Court’s judgment. They are in a Catch 22 situation over the UPSC asking the APPSC to reorganise mains.
“For all the 606, who reached the interview stage, re-writing the mains after a gap of two years is like asking the Mahendra Singh Dhoni and his team India, to replay all the matches in the 2011 World Cup to legally win the cup,” said Sowjanya, who qualified for the interview.
The last time, the AP government (then united) had held the APPSC- Group-I examination was in 2012. About 1.7 lakh candidates had written the examination for about 314 posts in various departments, which was held on May 27, 2012.
The results were out on June 6 in the same year. After the initial cut off marks was enhanced to 91 out of 150, 15,000 aspirants wrote the mains that were held between September 18 and 28 in 2012. Finally, 606 candidates were selected for interview and it was conducted between January 28 and March 21, 2013.
Their dreams turned sour when the AP Administrative Tribunal (APAT) was approached by a few candidates for six wrong questions in the papers. APAT referred it to the UPSC, which enhanced the number of qualified persons for mains to 15,209 and ordered a re-examination of the mains. Basing on the modified notice of APPSC, the 606 students filed a writ in the Apex Court, and it is still pending.
Giving an insight into their plight, Sowjanya said, “I opted out of research to serve the State. I was married and had a kid who was four-year-old. It impossible for me to take up that grind once again,” she lamented.
Like Sowjanya, there are many who have left their jobs to prepare for the examination and are now caught in a state of flux, said N. Sreenivasa Rao of Vinex Academy.

Hi likit, there is a difference b/w haryana psc case and our case. Here, the results are not yet declared. Even, We appeared for Mains and further the interview, with a condition that our results/exams are subjected to the outcome of this case. That means, We, in no case, have a right to question the judgment as we have already agreed to the condition and further appeared for the exams/interviews.

Will APPSC agree to conduct mains again in the first case or will it shy away citing some reason?
We need to wait and see how the distribution of the 300 odd posts will happen between the 2 states. The reaction and response from the Telangana PSC is another thing that we need to wait and watch out for.

The Remaining 69 Posts are State Wide Posts . According to Year of Schooling in their respective Districts an Aspirant get alloted either to andhra or Telangana

Anyone who has not been a party in this case or severely aggrieved by this verdict can file a Curative pt. And,there is no time limit to do so...In a way, the doors are still open.,,..,,..Wt do u say?
There is an error in the Eenadu Article posted on 4th March. APPSC hasn't appealed to rectify the questions, rather it opted to delete the questions, based on SC judgment. Even the Court was reckless in correcting the questions,,,thereby allowing them to delete those 6 questions.
1. Not a single interview candidate will proceed with further litigation, as it would only harm the remaining interests of interview candidates.
2. You only must file the curative along with any like minded people who want to cancel the notification.
The concept of Fait Accompli can be applied to this whole matter. There are certain things in the Judicial-Politco Administrative setup that once the ball has set rolling and its momentum has expanded beyond a certain point/stage, it is next to impossible to alter such things. The case in point is Bifurcation of AP, Once announced, it was always going to happen.
Sometimes it happens , that Justice may not always win. Justice is always relative in Civil matters. And in Civil matters at least the highest court of the land will try to protect its image lest the power of the institution may erode in the eyes of the other organs of the state. The internal mechanisms of the Supreme Court will allow for dissenting judgments ( Assuming another round of Curative Petitions will be filed) only when sustantial questions of public policy and governance are raised. This Group 1 case fortunately for some/unfortunately for some does not fall into the said category. Supreme Court will not allow to hurt the egos of their judges on simple civilian recruitment service matters. But if any aspirant or their aliases want to increase the bank balance of Supreme Court lawyers , they can indulge in filing Curative petitions.

Hello Ramesh G, You need to clarify whether you were disqualified in prelims or you didn't take the mains examination/ In either case, you are not eligible to write the Mains as per SC judgment. If you were not qualified due to erroneous key, you can still file a Curative petition in SC, as you are aggrieved by its verdict. But if you fall in the second category, i.e, did not write mains due to some reasons, then you have no other alternative except to prepare for the new notification. All da best!
Helo Ramji, My interest is not in cancelling the notification. You must be very clear on this. Even the court won't accept such a Plea. My intention was to make it clear to all those who were affected this judgment, that the doors are still open to file a curative petition as there is no time limit to file such a petition. ఎన్నికల తర్వాతే ప్రకటన: శాఖాపరమైన పరీక్షల నిర్వహణకు సంబంధించిన ప్రకటనను టీఎస్పీఎస్సీ మార్చి నెలాఖరున విడుదల చేసే అవకాశాలున్నాయి. ఇప్పటికే సంబంధిత ఏర్పాట్లన్నీ పూర్తయినట్లు సమాచారం. ప్రభుత్వం ఈ పరీక్షల నిర్వహణకు అనుమతిచ్చి రెండు నెలలు దాటింది. అయితే అభ్యర్థుల నుంచి వసూలయ్యే రుసుమును జమ చేసేందుకు బ్యాంకులో కరెంటు ఖాతా తెరవటానికి అనుమతి లేక ఆలస్యమైంది. ఇటీవలే ప్రభుత్వం కరెంటు ఖాతాకూ పచ్చజెండా ఊపింది. ఇంతలో ఎమ్మెల్సీ ఎన్నికల నిబంధనావళి అమల్లోకి రావటంతో పీఎస్సీ పరీక్షల ప్రకటన విడుదల చేయలేకపోయింది. ఆ ఎన్నికల ప్రక్రియ పూర్తికాగానే ప్రకటన విడుదలయ్యే అవకాశముంది. అంతకుముందు పీఎస్సీ వెబ్సైట్ను ఆవిష్కరిస్తారు.

I heard one of the coaching institutes say that the list would be released in 2-3 weeks and the exam would be conducted in 3-4 months.

@Vagdhati, I spoke to an institute called Sri Medha in Ashok nagar. They gave me the information that the mains would be held soon... say around a max of 3-4 months down the line.
I am not very confident about this news but anyone in this forum can validate if they have some news on this...

APPSC HAS TO ACT WITH IN ONE MONTH.OTHER WISE ANY ONE CAN FILE CONTEMPT IN SC.AS AP GOVT NOT INTRESTED IN FILLING VACANCIES,THERE NO POSSIBILITY OF CONSTITUTING APPSC NEW BODY IN NEAR FUTURE .IN THESE CONDITIONS WHO WILL COME TO RESCUE OF WORST HITTED CANDIDATES.......
@likitcool, Do we really need a new APPSC board constituted and a new chairman appointed to conduct the remains?
Can't the exam be conducted by the current board of 3 members? Should the APPSC wait for a chairman to be appointed to get the ball rolling?

@navin, if there is no political will, there is nothing even a fully constituted appsc board can do.
Similarly, the vice versa is true.
Now appsc will wait till a contempt petition is filed in sc. Completely shameless. No credibilty whatsoever. In shadows of secrecy and political fluctuations , appsc is playing the flute when there is loss of valuable and precious time for everyone concerned.
