Suppose if appsc releases new list along with key and cutoff as per your wishes, there may probably be new cases, saying that instead of deleting those 6 kindly revise them which have answers, so that they may also be eligible to write mains.As usual 2012 lo jariginatte, appsc yemi pattichukokunda mains pettestundhi. ee saari kooda malli moodo mains jargali avi rassai interview daaka vellalli ane vallu untaru, probably they may pursue it, and the cycle repeats for fourth time and futher with another issue.

whn appsc deletes 6 wrong questions , it is setting a level playing field. no one loses out of this. the paper will be corrected out of 144 and cut off will be reduced accordingly.
some ppl might lose who answered those 6 "correctly" and other questions wrongly. but this kind of deletion is done by UPSC also. no one questions thr !!!! whn a question is controversial , logical option wud be to DELETE.

right.i am also on the verge here. so focussing completely on bank exams now. in current situation ,appsc notifications wont happen unless a miracle happens. if u r under 30, in november/december SBI associates PO notification is coming. start preparing for tht if u r free. its a decent job . appsc ki elagu age limit ledu. next notification ki age limit may be 38 or 40 !!

when inter exams can be conducted, when bank exams can be conducted, why not appsc. Frogging hypocrisy. If these are of range of inter and bank exams, those two candidtes couldn't have went till SC, rather could have left in the beginning itself and tried for other jobs or new notifications.
If you want why appsc is not conducting/when it is going to conduct mains, better contact them and convey any information you are given, to us, so that we may also know updates

as we had tight evidence abt those 6 questions , we won the case. appsc cudnt provide evidence in tribunal, HC and SC. thtswhy it lost the case. its going to lose again in review petition if it files.

Your intrest in group 1 case, though you are not party to it as awhole, it self shows, why this exam is difficult to conduct, in case of contraveries are there.
You are right about other exams, which are zonal in nature. But i assume that, though they are zonal in nature around 15% are for other zones. So in future repatriation of those 15% to their own zones could be a problem. That's why it seems, these guys are not taking steps to fill them.

we argued tht those 6 questions are wrong in the key. appsc cud not produce evidence to counter our arguments. so honourable judge concluded tht these 6 questions shud be deleted since it didnt want to leave things in appsc hand again. thr is no expert committee to decide the correct answers. if appsc allowed UPSC report to come out , then SC wud hav definitely asked for correct answers for 6 questions.

yep. appsc has already raised this issue in SC tht they can conduct mains for new candidates. but SC vehemently rejected saying tht dont think of conducting 2 mains. i am told tht thr is a prev judgement tht thr cant be 2 mains.
so the only option left was fresh mains.
appsc got the signals in august itself tht its going to lose the case. sad tht they didnt take any alternative measures to speed up the process.
So in totality, after the review petition is filed, there can be 2 outcomes. Either the earlier judgment is reversed and appsc mops up the mess or fresh mains have to be conducted.

You say you have strong proof of correct answers, if that is so why SC didn't took notice of it. Even if it didn't, why did not your lawyers strongly objected for revision based on your proofs itself, if not UPSC report.
It means SC dont have belief in your proofs of correct answers, then in that case whats the point in filing case it self!?
Regarding two mains also, iam not sure, in which case did SC said like that. There are many instances where SC changes its views on same topic/similar topic, based on details available at that time.(Ref: G1 paper 2 sec 3- constitutional cases like keshvananda bharti etc...)
Based on the data provided in the review petition, probably SC may relook into case once again. Let it decide, to conduct mains for all or new or going to UPSC or cancel case itself or declare results it self etc, we Don't know , until the review petition is filed and its aftermath events.
Technically whats the problem to appsc in conducting exam shall be asked them only. May be they are anticipating that with the deletion of questions some may come in the list, who probably wont be there if revision of key takes place. Say if they file a case, they need to go to SC once again or any thing else. None of us are aware. Those who are in touch with that insider can probably gather info and update it.

among those 6 , some were controversial(means no right answers). in such cases , best option wud be to delete them. this practice is followed by UPSC also.
key correction shud be done by the expert committee. appsc has also appointed an expert committee whose report was thrown in trash by HC and asked appsc to follow UPSC report.it shud hav followed the order . but it went to SC . thr also we proved tht key was wrong relating 6 questions.
if thr was any UPSC report , then SC wud hav directed appsc to revise the key rather than deleting.
now tell me whr did the so-called insider help us ?? did he send some secret files to us and we won the case ??? our evidence was based on official textbooks and govt documents. those can be found in any book market. u know tht.

Boss, Iam here to question you "crusaders of justice" on one point, why didn't you and your lawyer forced for UPSC report as asked by HC, if you feel that your proofs only made SC to believe that key of APPSC is wrong. that UPSC report could have cleared the way for either total deletion of 6 questions or partial revision or deletion of 6 questions.
On the first day of hearing itself, SC gave order of no need of upsc report, atleast at that time u might have thought of it.
What if there are few more cases like "that out the 6 deleted questions, there is answer for 1 or 2 or 3.. questions, you please kindly revise the key so that we may be in the list of newly mains candidates", if SC gives ruling in their favour then there shall be 3rd mains list, here also, there may be cases from 2nd mains list candidates who are not in third mains list candidates.
we could have avioded this probable future mess. isn't it?
appsc shld give 6 marks to everybody. interview candidates should be given 6 marks extra in their mains exam. this is a amicable settlement. now missed and interview can reach agreement.

even if UPSC proves 4 questions are wrong , then also SC wud hav ordered fresh mains. so upsc report wont be a big factor here.
how can you say deletion avoids future case, what if after relase of new mains list, if some candidate knows that he lost chance to write mains with one mark, and if he comes to know that had there been revision of 1 or 2 questions which have one correct answer like seshachalam, etc goes to SC and file a petition on injustice caused to him, because of deletion of 6 questions rather than revision of few and deletion of others?

What if they say out of 4 Q's referred to them some are correct or some have other answer or some have no answer at all or some have multiple answers, where marks can be given to correct answers as happened in earlier exams also.
Then whole of the case comes back to starting position.

after reaching the present stage also we are not coming out to fight. some interviewed candidates are telling that we can write in better way than early- anything can happen- that person may not even get the opportunity to attend the exam also-

awake - Arise -fight till for favorable judgement-review petition....... division bench.....extra-ordinary powers of president of india

Let us first use our commonsense before thinking about review petition and Extra ordinary powers of President. Mains is the basis for interview, and Prelims is the basis for mains.If the VERY FOUNDATION IS DEFECTIVE(prelims due to 6 wrong qs)how would be the interview list without any defect?All we agree that 606 are meritorious.If it is the case, why to fear writing the remains.I think only who accidentally entered to interview list may hesitate for writing remains.The original 303(FINAL LIST ) may not fear writing the exam. There may be no use for going review petition,as the ENTIRE BASIC FOUNDATION OF THE CASE FOR REVIEW IS VERY WEAK.(6WRONG QS)
If 303 or 606 are meritorious, why to let them write once again at all!

yah, it seems appsc may take its time to leisurely file review petition, and even if it i accepted, because of hearings and other procedures, it takes lot of time and by the time judgement is give, state might be on the verge of made into two or more pieces. Finally we all shall be in history as candidates who wrote either prelims or mains or interview in the last probable G1 of AP
i agree with u brother. whn the entire foundation is defective , how to know who among the 606 entered the list on wrong prelims marks ? even if appsc goes to SC again , it will lose the case. whn u go to larger bench , thr will be more scrutiny of the facts. is thr any concrete evidence with appsc ? no. thtswhy its not filing the review petition soon.
even if state is divided , appsc will be thr for 10 yrs. so they need not cancel this notification. best thing to do is announce the dates as soon as possible and finish the process before elections.

I only agree that most of the 606 are meritorious but some of them are not due to DEFECTIVE FOUNDATION(6qs wrong).In competitive exams MERIT changes by even half mark.If the 6qs are wrong, how you can bluntly conclude all 606 are meritorious?
The outcry by the 606 people is understandable.All this is a part of human emotions.I request you first come to neutral point as your views are biased and emotional.Also think about other side of the coin.Unleash and awake your intellectual traits.

Hi... I am one of the 606 Interviewed Candidates. i came to know that even if we (or APPSC) file the Review petition, the hearing goes to the same bench with one additional Judge. So, I doubt there will be any change in the decision even with a review petition.
It would have been better if the APPSC has argued to let the 200 Odd candidates to permit to the Mains directly in the next notification. And if any one of them gets selected, give them seniority with the present batch. That would have been a better solution to the problem, because it is not that we are the only sufferers but also those who are aspiring to appear for the next notification (freshers), they too are in a dilemma.
It is enough dragging the issue. Let us gather at the APPSC on Saturday and ask -
1) Whether APPSC is filing a review petition.
2) If so, let us make sure that APPSC asks the Supreme Court to give decision within a short period (not dragging on for months) as it comes under Public Interest Litigation.
3) If not, it is not advisable to file a review petition by the candidates as the bench will consider it a self serving petition.
4) If not, let us ask and demand the APPSC to conduct the Mains as soon as possible by announcing the results of the newly selected candidates .
If we don't act now, the APPSC will prolong the issue for years ti come. Once the election notification is released, APPSC will use that excuse to prolong the issue.
And once the State bifurcation notification gets released, the Mains will be postponed entirely.
SO, lets gather at APPSC on Saturday by 11 AM and resolve the issue once for all.

It is not a review petition. It is modification petition to modify the SC order. It has been filed today.

The first method to revive a lost case is to file an application for clarification, another technique is to file an application for modification of the order. If both stratagems fail, there are two more options. The first one is moving a review petition and if that does not work then a curative petition is the last resort.
If APPSC has really filed an application for modification of the SC order/judgement, then it would plead to highlight the technical hurdles in the implementation of the order/judgement. It is generally perceived as a ploy to re-argue the case.

In the backdrop of this lack of proper info regarding APPSC's moves, there may be truth in what our friend Vamshi Krishna said as far as APPSC filing an application for modification of the order. Because this appears to be the best way forward at this point. This is my personal view and open to introspection.
And Srinath, regarding a review petition, the SC April/May 2013 on a judgement emphasized that a review was justified only when there was a serious error in the judgment or a glaring omission which it failed to notice. Keeping this in mind I am not too sure if APPSC has such serious and glaring data to file a review.

if exam is allowed only for 209 candidates, can the commission take written agreements from all those who attended final interview that no matter what the result, no one can file any further litigation proceedings? This should give a finality to the issue.
I remember that a couple of months back one of our friend had posted in this discussion forum that Hon'ble SC during the arguments made it clear that PSC should not think of conducting a second mains only for those who newly qualify. If the aruguments on those lines had already happened, then I wonder how strongly will appsc push its case for conducting mains for only 209 candidates.
Another point it may highlight of citing technical difficulties or hurdles like the current political situation and the uneasy situation in the state may not really find favour. I feel it needs to come up with something really strong to make an impact. Enough time has been lost and sincerely hope to see an end to this long drawn case very soon.
Does anyone know when the hearing is going to come up? Understand that the SC has diwali holidays till 8-Nov.

In the modification petition filed by APPSC, it says that after deleting the 6 questions 209 new candidates have become eligible. Was just wondering as to how many candidates would have lost out from the old list because of this?
APPSC has filed this petition close to a month back. And the wait seems eternal. No signs of any movement.
Is anyone aware APPSC's plans to release new notifications in the near future? I understand the govt has given its nod.
The higher judiciary had its basket full dealing with allegations of sexual harassment by a law intern. After dealing with that, SC may widen its gaze on this petition. Or it may decide to include this in the petition against bifurcation that will eventually come up in the following days and give an all encompassing judgment.
