@sempli, The issue is simple, but u r not simple. Had u not cleared prelims, u certainly wud hv checked da key. If u had checked the key, u must hv found wrong answers. Then, obviously, u wud hv fought for justice. Now, u r simply awaiting for writing prelims again just bcoz some one has been fighting for it. Is this fare on ur part?

hi frnds, all the review petitions were dismissed today. The judgment will be ready by 9th August. That's all. I heard the news that APPSC is not willing to conduct the exam in the present scenario. All the best...

hi vagdhati, whatever I have posted today is true. There were no arguments held today as is the case with any Review petition when it's in judge's chamber. Since our frnds have posted false aspects, I had to reply in that way. Any ways, wait for the order till 9th August. All the best guys...@Prerana, naaku pelli avaledu. The final resort, either PSC or the interviewed ones have, is the 'curative petition'. It can be filed in civil matters too. So, let's wait and see! I wonder what decision will the Telangana Govt.take? Bcoz it did not accept the recruitment of CDPOs as it was held in united A.P. The case is still lying in the court. We can hope for the best solution our issue. Bye, Gud night...

According to my sources, APPSC would cancel the notification and the vacancies would be allocated to respective states bcoz cadre strength has already been bifurcated which included these posts too. Best of Luck guys!!!

Hello Everybody,

I am new to this forum.I was hoping someone can help me out here. I have attended interview in 2013. But as I understand from news from various sources and SC judgments, chances of appointments being released are rather bleak. I dont know for sure but that is my opinion. But I was told that August 6th 2104, the last decision will be taken and this issue will come to an end. Secondly, If not this,will there be any new notifications in future? I am not able to get information from SC regarding yesteday's decision and I can't rely on news from ashok nagar. APPSC is not lifting calls. So could anybody throw some light on exactly what happened yesterday and what will happen next in the course of this case?

The news in ashok nagar is already posted in this blog. To what extent that is true, I am doubting the authenticity. Morning there was a group discussion in library that appsc has won. And comments in this blog is saying different that review petition has been dismissed. so very hard to believe anything really.

Curative Petition
A Curative Petition may only be filed after dismissal of a review petition by circulation. It is
entertained as a matter exception, as it amounts to re-examination of a final decision of the
Supreme Court, although on limited grounds.
Grounds
In the decision of Rupa Ashok Hurra v. Ashok Hurra, (2002) 4 SCC 3881
, the Supreme Court
lists the grounds on which a curative petition may be entertained. It, however, does specify that
the list is not exhaustive2
. The grounds stated are:
1. Violation of the principles of natural justice3
: in that the Petitioner was not a party to
the lis but the judgment adversely affected his interests, or if he was a party to the lis, he
was not served with notice of the proceedings and the matter proceeded as if he had
notice
2. Bias4
: where in the proceedings a learned Judge failed to disclose his connection with the
subject-matter, or the parties giving scope for an apprehension of bias and the judgment
adversely affects the petitioner
3. Lack of Jurisdiction5
: where the order passed by the Supreme Court is without
jurisdiction
Other Requirements
1. The Petitioner must state in the Petition that6
:
a. the grounds taken were also taken in the Review Petition
b. the Review Petition was dismissed by circulation
2. The Petition must contain a certification by a Senior Advocate that the above
requirements have been fulfilled7
3. The Petition has to be first circulated to a bench of the three seniormost Judges and the
Judges who passed the impugned judgment, if available8
(hereinafter the “Bench”).

The above decision of Rupa Ashok Hurra serves as the „landmark‟ decision on the subject of

decisions, among others:
 CBI v. Keshub Mahindra, (2011) 6 SCC 216
 Bakshi & Co. v CST, (2005) 12 SCC 398
 Sumer v. State of U.P., (2005) 7 SCC 220
 Sidram S. Patil v. Gurunath Shivappa Patil, (2005) 2 SCC 358
The above decisions maintain that only in the rarest of rare cases where very strong reasons exist
the Petitioner is entitled to relief under this remedy, ex debito justitiae

Decision by sc on curative petition is given in 6-7 months.

Ex:Curative Petition(Civil) 126 OF 2014

Points of Interest:
2 Order XL, Rule 1 of Civil Procedure Code lays down grounds for a review petition but the
Supreme Court under its powers in Article 145 has made a distinction between grounds for filing
a civil review petition and those for filing a criminal curative petition. See Supreme Court Rules,
Order XL.

2.After curative petitions have been circulated before the relevant judges, they are then heard in the
open court and the parties to the matter are issued notice to appear before the Court. None of the
Civil Curative petitiona have ever proceeded beyond the notice stage but as of December 03 2006,
2 criminal curative petitions had proceed beyond the notice stage and were dismissed that proof
of surrender as directed by the Court was dismissed beyond the period thar stipulated by the
Court. These petitions were Deo Narrain Mandal v. State of Uttar Pradesh, Curative petition (CR.L.)
No.2 of 2005 and Raj Deo Rai V. State of Uttar Pradesh, curative petition (Cr.L.) No. 19 of 2005.

ok here is the story. appsc will file curaative petition this month and be prepared for the final and final judgment in 6 months. my guess is SC will dismiss curative petition, but many of you will get so much angry on me for saying this. @kmt, where did u find the order? We hv checked the official webistes which are not updated yet. @Namrata, U said that APPSC has very thin chances of succeeding in Curative petition. How abt the chances of the Respondents? The ones who filed the cases in Tribunal and HC (Not qualified in Prelims + Interviewed candidates). They must be having brighter chances for Curative as their pleas were considered in both the courts. They must have serious averments against the SC judgment. Isn' it???

The ones who might hv pleaded for Review to correct the key instead of deletion by referring it to upsc and then conduct the exam afresh. The ones who were intereviwed might have pleaded for the announcement of result and give postings as the case has been delayed for around 2 yrs. In this instance, Both have their strong averments against the Judgments. Aren't they?

Technicalities aside, A curative petition is nothing but a glorified review petition. It is a recent innovation in Indian jurisprudence. Moreover in civil cases, to my knowledge it has been only applied once. There is no overwhelming change of circumstances nor does this case carry so much emotional weight (according to judges)(It doesnt matter how the respondents or the defendants feel.) But As you rightly pointed out, I couldnt find any order in sc website, only the information that the case was disposed. Coming to technicalities, now it just a matter of opinion and perception, of not us("us" means everyone who is connected to the case -directly or indirectly), The review petition has been disposed without calling for arguments clearly give some insights on the fate that holds for any future curative petition, after a time gap of 6 months in future maybe in Jan 2015.( 6 months I am saying because of past precedent, which the cases I have quoted earlier). Another interesting fact for curative petition in civil cases in India is that, to my knowledge (anybody can correct me If i am mistaken), there have been only three civil curative petitions that have been lodged, two of which have become stale and only on one occasion was a curative petition disposed.(look for case number in my above comments). That is the official position of the case TILL NOW. AS IT STANDS. We can create lots and lots of artificial conspiracy theories like a typical Indian court case, but the thing that matters, the point on which every string rests is that, the review petition has been dismissed without calling for arguments. Arguments which were critical for any party associated with this case.

APPSC to issue a statement and press conference to clear all doubts of students. There are news reports that appsc is contemplating to abolish future g-1 recruitment in andhra pradesh because of ongoing case and govt is not interested. All g-1 posts to be filled by promotions of present staff.

As per the law only 1/3 of the posts can be filled through promotions and 2/3 rd of group-1 posts through direct recruitment.Even appsc or state government cant change this.

Does appsc really ban future g1 notifications? seems like that is the reason it is dragging this case. present employees also want promotions to gr1. when sc relased order of disposal of review petition, many thought results were released. So what now?

ఈనాడు, హైదరాబాద్‌: తెలంగాణ పబ్లిక్‌ సర్వీసు కమిషన్‌ (టీపీఎస్సీ) ఏర్పాటుకు ఒకట్రెండు రోజుల్లోనే ఉత్తర్వులు జారీ కానున్నాయి. టీపీఎస్సీ దస్త్రానికి రాష్ట్ర గవర్నర్‌ నరసింహన్‌ ఆగ‌స్టు 7న‌ ఆమోదం తెలిపారు. రాష్ట్ర విభజన దృష్ట్యా ప్రత్యేక పబ్లిక్‌ సర్వీసు కమిషన్‌ ఏర్పాటు చేసి, పెద్దఎత్తున ఉద్యోగ నియామకాలు చేపట్టాలని తెలంగాణ ప్రభుత్వం నిర్ణయించింది. ప్రభుత్వ ప్రధాన కార్యదర్శి అధ్యక్షతన కమిటీని ఏర్పాటు చేసి నియమనిబంధనలను రూపొందించింది. జులై 16న జరిగిన మంత్రిమండలి సమావేశంలో దీన్ని ఆమోదించి దస్త్రాన్ని గవర్నర్‌కు పంపించారు. గవర్నర్‌ దస్త్రాన్ని పరిశీలించి ఆమోదం తెలిపారు. ఛైర్మన్‌, సభ్యులు కమిషన్‌కు కీలకమైనందున.. సచ్చీలురైన విశ్రాంత ఉన్నతాధికారులు, నిపుణులు, అనుభవజ్ఞులను ఎంపిక చేయాలని ఆయన సూచించినట్లు సమాచారం. గవర్నర్‌ ఆమోదంతో దస్త్రం ప్రభుత్వానికి చేరింది. ఆగ‌స్టు 8న‌ ఈ దస్త్రాన్ని ముఖ్యమంత్రి చంద్రశేఖరరావు పరిశీలించనున్నారు. ఆయన అనుమతి పొందిన వెంటనే కమిషన్‌ ఏర్పాటుకు ఉత్తర్వులు జారీ కానున్నాయి. తొలుత ఒక ఐఏఎస్‌ అధికారిని కార్యదర్శిగా నియమించి కమిషన్‌ను ప్రారంభించనున్నారు. ఛైర్మన్‌, సభ్యుల నియామకాలకు కొంత సమయం పడుతుందంటున్నారు.
చురుగ్గా ఏర్పాట్లు
తెలంగాణ పబ్లిక్‌ సర్వీసు కమిషన్‌ కార్యాలయంగా ప్రస్తుత ఏపీ కమిషన్‌ కార్యాలయంలోని నాలుగు, అయిదో అంతస్థులను ఎంపిక చేశారు. ఉద్యోగుల విభజన కూడా పూర్తయింది. ఏర్పాటు ఉత్తర్వులతో పాటు ఉద్యోగుల నియామకాలు, కార్యాలయ విభజనకు ఆదేశాలు జారీ కానున్నాయి. కమిషన్‌ ఏర్పడిన వెంటనే పెద్ద ఎత్తున ఉద్యోగ నియామకాలు చేపట్టాలని ప్రభుత్వం యోచిస్తోంది. ఇప్పటికే శాఖలవారీగా ఖాళీల వివరాలు సేకరించాలని ఆదేశించింది. ఉద్యోగుల విభజనకు సంబంధం లేని కొత్త నియామకాలను చేపట్టాలని భావిస్తోంది.

@anil, This is in reply to your earlier query, the contents may not be exhaustive and anybody is free to make additions/deletions depending on their allegiance and "vested" interests in this vexatious case.The opinion expressed is purely personal.

First and foremost thing everyone has to agree as a base that the 2-year extended honeymoon is over for APPSC. Now it is feeling the heat. It cannot hide behind legal curtains.

Coming to the averments pointed out:

1) SC has made a observation that all 209 candidates and mains written candidates belong to the same category of "Unemployed". Any other bench will reaffirm the same.That is a critical observation.Based on this sole fact, SC ordered conduct of re-mains. I think this argument will not hold good.

2) I am not aware if SC has factored in the arguments of any other category of aspirants in its final judgment,other than those of 209 candidates and mains written candidates. If such a scope exists also, then also the logical conclusion can be
fresh mains at best.

Whatever the scenario its Game Over for everybody. Its just the wait that lingers.

The State of Telangana came into existence with effect from the appointed day i.e., 02.06.2014.

Section 83(2) of the Andhra Pradesh Re-Organisation Act, 2014 (Central Act.6/2014) providing for constitution of a Public Service Commission in the Successor State of Telangana read as follows.

“83(2) There shall be constituted a Public Service Commission in accordance with article 315 of Constitution by the successor State of Telangana, and until such Commission is constituted, the Union Public Service Commission may, with the approval of the President, agree to serve the needs of the State of Telangana in terms of clause(4) of that article”.

Accordingly, the following Notification will be published in the Extraordinary issue of the Telangana Gazette, dated: 08.08.2014.

2011లో 314 గ్రూపు-1 ఉద్యోగాల భర్తీకి నోటిఫికేషన్ జారీచేసి 2012 మే 27న ప్రిలిమ్స్ పరీక్ష నిర్వహించారు. దీనికి సంబంధించి విడుదల చేసిన 'కీ ప్రకారం ఆరు తప్పులు ఉన్నందున న్యాయం చేయాలని కోరుతూ పలువురు అభ్యర్థులు పరిపాలనా ట్రైబ్యునల్‌ను ఆశ్రయించారు. అనంతరం అభ్యర్థులు హైకోర్టును ఆశ్రయించగా, ఆ ఆరు ప్రశ్నల విశ్వసనీయతపై యూపీఎస్సీని నివేదిక ఇమ్మని కోరింది. దీంతో ఏపీపీఎస్సీ సుప్రీంకోర్టును ఆశ్రయించగా.. ఆ ప్రశ్నలను తొలగించి మళ్లీ ప్రధాన పరీక్షను జరపాలని న్యాయస్థానం గతేడాది అక్టోబరులో తీర్పుచెప్పింది. అయితే, ఆ ఆరు ప్రశ్నల వల్ల 209 మందిపైనే ప్రభావం పడిందని.. వారికి మాత్రమే మళ్లీ పరీక్ష నిర్వహించేలా ఆదేశాలు ఇవ్వాలంటూ ఏపీపీఎస్సీ చేసిన ప్రయత్నాలు ఫలించలేదు. ఇదే అంశంపై మరోసారి క్యురేటివ్ పిటిషన్ ద్వారా సుప్రీంకోర్టును ఆశ్రయించాలని ఏపీపీఎస్సీ యోచిస్తున్నా ఎంతవరకు ఫలితమిస్తుందన్నది ప్రశ్నార్థకమే.
అభ్యర్థుల్లో ఆందోళన..
గ్రూపు-1 మెయిన్స్ పరీక్ష మళ్లీ జరిపే సూచనలు కనిపిస్తుండటంతో అభ్యర్థులు ఆందోళన చెందుతున్నారు. 2012 మేలో జరిగిన ప్రిలిమ్స్‌ను ఒకటిన్నర లక్షల మంది రాశారు. వీరిలో సుమారు 12 వేల మంది అదే ఏడాది సెప్టెంబరులో మెయిన్స్ పరీక్ష రాశారు. అందులో ఎంపికైన దాదాపు 600 మంది అభ్యర్థులకు గతేడాది ఏపీపీఎస్సీ ఒకే బోర్డు ద్వారా మౌఖిక పరీక్షలు(ఇంటర్వ్యూ) నిర్వహించింది. వాటికి హాజరై ఉద్యోగానికి ఎంపికవుతామన్న నమ్మకంతో ఉన్నవారికి తాజా పరిణామం మింగుడుపడటంలేదు. మరోవైపు రాష్ట్ర విభజన నేపథ్యంలో ప్రధాన పరీక్ష నిర్వహణకు రెండు రాష్ట్రాల మధ్య సయోధ్య అవసరం.
ఏమవుతుందో..?
ఏపీపీఎస్సీ రివ్యూ పిటిషన్ ఆగస్టు 6న సుప్రీంకోర్టులో తిరస్కరణకు గురైన నేపథ్యంలో కమిషన్ మరోసారి సమావేశమై న్యాయనిపుణులతో సంప్రదించి క్యురేటివ్ పిటిషన్ దాఖలుచేసే అంశాన్ని పరిశీలిస్తోంది. అయితే.. రెండుసార్లు సుప్రీంకోర్టులో చుక్కెదురైన నేపథ్యంలో సానుకూలత రావడం కష్టమేనని భావిస్తున్నారు. ఈ పరిస్థితుల్లో మళ్లీ ప్రధాన పరీక్ష నిర్వహించాలంటే తెలంగాణ, ఆంధ్రప్రదేశ్ పబ్లిక్ సర్వీస్ కమిషన్‌ల మధ్య సంప్రదింపులు జరగాల్సి ఉంది. మరోవైపు.. ఉద్యోగులు, అధికారులు రాష్ట్రాల వారీగా విడిపోతున్న నేపథ్యంలో..ఈ పోస్టుల భర్తీ అంశంపై రెండు ప్రభుత్వాల మధ్య చర్చ జరగాల్సిన అవసరం ఉంది. తాజా పరిణామాలపై నిర్ణయం తీసుకునేందుకే సమయం పట్టనున్న పరిస్థితుల్లో మళ్లీ పరీక్ష నిర్వహించాలంటే ఇంకా సమయం పట్టొచ్చు.

@Namrata, thanx for the reply. But u hvn't answered my previous query. APPSC and all of us are talking abt 209 candidates. What is the efficacy of this no. Do u still believe in appsc that it has given accurate figure. For ur kind info.,Review petition No.772-774 were filed by the candidates based on this issue only. They infact, have questioned the authenticity of this figure. Bcoz, appsc had submitted a cooked up table showing the figure 209 just to prove that those 2 candidates would not qualify. Their R.P clearly proves how fake this no. is and questions the authority of S.C on deleting questions.

“H.P.Public Service Commission Vs Mukesh Thakur & Anr. On 25th May 2010; Civil Appeal No. 907 of 2006”- Para No.12, Extracted below:
“In the facts and circumstances of the aforesaid case, three basic questions arise for consideration of this Court:- i) as to whether it is permissible for the court to take the task of Examiner/Selection Board upon itself and examine discrepancies and inconsistencies in the questions paper and valuation thereof.”

“It is a matter of chance that the High court was examining the answer sheets relating to law. Had it been other subjects like physics, chemistry and mathematics, we are unable to understand as to whether such a course could have been adopted by the High court”

“Therefore, we are of the considered opinion that such a course was not permissible to the High court.”

“Manish Ujwal And Ors. Vs Maharishi Dayanand Saraswati University on 16th August 2005” - Para No. 9, Extracted below:
“The High Court has committed a serious illegality in coming to the conclusion that "it cannot be said with certainty that answers to six questions given in the key answers were erroneous and incorrect". As already noticed, the key answers are palpably and demonstrably erroneous.”
“In that view of the matter, the student community, whether the appellants or interveners or even those who did not approach the High Court or this Court, cannot be made to suffer on account of errors committed by the University. For the present, we say no more because there is nothing on record as to how this error crept up in giving the erroneous key answers and who was negligent. At the same time, however, it is necessary to note that the University and those who prepare the key answers have to be very careful and abundant caution is necessary in these matters for more than one reason.”
“First and paramount reason being the welfare of the student and a wrong key answer can result in the merit being made a casualty.”

“One can well understand the predicament of a young student at the threshold of his or her career if despite giving correct answer, the student suffers as a result of wrong and demonstrably erroneous key answer.”
“We mention few of those; first and paramount reason being the welfare of the student and a wrong key answer can result in the merit being made a casualty. These above two cases clearly show that SC has no right to delete the questions instead it can ask a committee/body for its verasity. Here, in our case, SC has done two errors. 1. deletion of 6 questions instead of correction; 2. Rejection of Review petitions. If the candidates file curative petition, definitely, it will be a blow to the present judges. Bcoz the Review petition of candidates ought to have valid grounds which were ignored by the present bench. bcoz they succeeded in both lower courts. And in Review petition, they have proved the malpractices of appsc. Letz see, what will happen???

APPSC is eager to file curative becoz they surely know that if the candidates' curative petition is accepted, then it will be a blow on their face. Bcoz they will expose the ill practices and disgusting attitude of the commission. They will also prove how it had submitted a cooked up table showing that only 209 are eligible to write mains. Most of us are not aware of these facts and believe that only 209 would qualify if the new list is drawn. It is in reality, the other way round. Around 800-1000 fall on each mark. So, there could be more than 2000 fresh canditates if the list is drawn. That is the reason why appsc has never talked about publishing individual marks list.It alone validates the cut-off. So none of us should believe what appsc says based on above facts. All the best...

@Anil, Just giving a preliminary glance at what you have said, I am assuming that there is another party to the case and their demand is fresh mains. And their demand is most potent which can stand the scrutiny of curative petition. My question. Has the SC in its last judgment and review considered the plea of this category?
Next, as someone earlier commented above, I also feel that this notification is as good as cancelled, taking into account, the complexities involved in dividing the merit list. This was pointed out in eenadu paper today.

Leaving aside, our own motives, one should definitely appreciate the efforts put on by those who filed the case. Isn't it, guys? Just ask ur frnds who hv benefited wid da key published in either Gr2 or any other exam. That is the outcome of this case by and large. Watz ur thought?

We have to make a dispassionate analysis. Every person thinks that what he/her thinks is called justice. Its best to leave Justice to the Judges. There is a saying. What SUPREME COURT MANUAL Says About CURATIVE PETITION

Even after dismissal of a review
petition under Article 137 of the Constitution, Supreme Court, may
entertain a curative petition and reconsider its judgment/order, in
exercise of its inherent powers in order to prevent abuse of its process,
to cure gross miscarriage of justice and such a petition can be filed
only if a Senior Advocate certifies that it meets the requirements of this
case. Such a petition is to be first circulated, in chambers, before a
Bench comprising of three senior most judges and such serving judges
who were members of the Bench which passed the judgment/order,
subject matter of the petition.

@anil, If appsc is lying about anything about the case, then it falls under the grave offence of perjury, which entirely is another matter.
I will draw attention to one point,When the concept of justice is talked, it has various interpretations,given the kaleidoscopic nature of the justice-seekers. Too much time has passed and like a hydra, many parties are surfacing adding to the vexatious nature of the case. Justice is heavily concentrated on the time-lag factor. Just as the aphorism goes, "Justice delayed is Justice denied", the universal characteristic of Justice would be to give an end to this.

@litlecool, Thanx for the lengthy analysis. You said 209 should go out inorder to give a way to 209. But my dear frnd, hw did conclude that only 209 will come in to picture, if the list is re drawn? Hw come u miss those who didn't even appear in Mains as U hv included 209, mains disqualified and interviewed ones. Plz check my previous explanation for this. U will cetainly get an idea. Don't think whatever psc says, is a Gospel. The authenticity of 6 questions was already proved in lower courts. It is this foolish judge, who is adamant and played with all of us. Had he sent all the questions to UPSC, then things would hv been settled once and for all. Another mistake that u hv made is High court did not order for fresh list for 144 questions, instead it asked UPSC secretary to send a report on the correct answers for 4 out of 6 questions. If these 6 questions are rectified and a fresh list is drawn for 150 questions, then whole scenario will change.

And my friend,likit said that only Re-mains will be the outcome. Hw does he know dat? Had he gone thru the arguments held in SC when case was listed in Jan'14? Can I tell u the reasons for accepting the Curative petition if filed by the candidates, Go thru the following:

1. Both lower courts had opined that the key was erroneous and ought to receive the opinion of UPSC.

2. Solid evidences were provided by the candidates to prove their arguments against these 6 questions.

3. PSC had submitted a cooked up table in the court with 209 figure. This can be proven if the petitions had been accepted.

4. SC has done error in deleting these questions which was condemned in some earlier case. It ought to hv recommended the issue to UPSC or any other body.

5. Having known the above facts and having gone thru the Review petitions, It should have allowed for arguments. Only God knows, whether Mr.Jasthi has gone thoroughly or not.

6. If these facts are presented in Curative petition, it certainly wud b a blow to not only PSC but also to this so called Justice and the court itself. It wud clearly expose the reality hw the judiciary is functioning.

6. Having gone through these facts, Out ignorant and innocent fellow friends simply believe in 209 and say blaa..blaa..blaa....

But what if the notification gets cancelled? We all will prepare for prelims, but u alone wud be reading ur own mains material. Kudos, When u r so mean to secure high marks than others, y did u copy n paste all da above stuff? just keep in for urself. Oh, u want to project as if u r the master of Mains. Isn't it? @Namrata, Just for the sake of discussion, I would like to ask u one thing. As we all know, there are nirbhaya cases being filed. So, u want to close/put an end to the case irrespective of the outcome and even at the luxury of releasing those culprits. Letz take another instance wherein the same case is pending for abt 2yrs and then at the end, the culprits are punished by way of imprisonment/Death penalty. Then also, wud u say, justice delayed, is justice denied??? As u rightly said, everything has its own interpretations n implications. Any ways, best of luck.

Hi Friends,
I find some observations which will help our case,

1). Supreme Court in its earlier decision on January 21st, mentioned that 2 exams(mains) is unjustful to the candidates. But in recent days some exams like CAT, SBI PO Exam, IBPS clerical....etc candidates are getting different papers in different weeks eventhough they are appearing for the same job. In CAT, GRE exams those candidates who appears on same day and sit sidebyside also get different papers. In our Civil Services exam also every candidate choose different optional of his own intrest. In all the cases by preparing different set of papers of same difficulty level, the examiners are protect the merit. So in our case also APPSC professors can give papers of same difficulty level and protect the merit as said by the court.

2). More over there is a lot of difference between Academic exams and Civils services, Group - 1 mains kind of exams. In these kind of exams instead of testing merely candidates knowledge, they test his approach and response towards Society and its problems. So by giving another set of papers also we can find the above said qualities.

3). By ordering APPSC to delete the 6 questions without considering the report given by expert commitee supremecourt did a mistake in our case. To counter this we can Quote the following case of Haryana Public Service Commission which was given by one of our friend.....

H.P.Public Service Commission Vs Mukesh Thakur & Anr. On 25th May 2010; Civil Appeal No. 907 of 2006”- Para No.12, Extracted below:
“In the facts and circumstances of the aforesaid case, three basic questions arise for consideration of this Court:- i) as to whether it is permissible for the court to take the task of Examiner/Selection Board upon itself and examine discrepancies and inconsistencies in the questions paper and valuation thereof.”

“It is a matter of chance that the High court was examining the answer sheets relating to law. Had it been other subjects like physics, chemistry and mathematics, we are unable to understand as to whether such a course could have been adopted by the High court”

“Therefore, we are of the considered opinion that such a course was not permissible to the High court.”

One more case which is also relavant to our case is

Manish Ujwal And Ors. Vs Maharishi Dayanand Saraswati University on 16th August 2005” - Para No. 9, Extracted below:
“The High Court has committed a serious illegality in coming to the conclusion that "it cannot be said with certainty that answers to six questions given in the key answers were erroneous and incorrect". As already noticed, the key answers are palpably and demonstrably erroneous.”

@009, Thanx for ur info. I didn't get what exactly r u trying to convey? You are right that the courts have no right to question the varasity of a question in an examination. But, it doesn't matter whether there is a fresh mains or second mains, unless and until the merit is not being compramised with the erroneous key. All our frnds are talking abt those who have been interviewed and those who just couldn't clear the Mains. Has anyone thought of those who have sufferred due to this key. They could be around 4000. Who will fight for them? Definitley not u, me and these so called intelligents. Had they missed the chance with that key, then they would hv know the pain. Now, all of us are in safe position. So, we keep quite and talk abt our rigths. But all of us should accept the fact that psc has done mistake and most os us have cleared due to that erroneous key only. We are living in a society and all of us are humans. So, letz hv some morality. Had any of ur relative not cleared prelims due to this erroneous key, then u wud hv talked differently. But now, u talk abt ur rights, Isn't it? I'm sorry to say dat, having qualified with that erroneous key wudn't make us eligible to write Mains or attend the interview. I know for sure that most of our frnds are worried abt the result just bcoz they already knew which post r they going to get? I know this doesn't sound nice but we should accept the truth too. If we don't hv that much courage, then what for, are we made of??? I'm sorry to say all this stuff. But at some point, we should be honest at least to ourselves. I am also an interview candidates. I expressed my view about writing re mains when the first SC judgement came, but some body scolded me. This is not a complex case. Recently my friend purchased a plot. After he got patta, sister of seller filed a partition suit and she took half of property. now my friend is begging money from seller. Justice starts from where wrong happens. Same thing in our case also. Nothing will happen except wasting money. This is not a case like Does law and order completely belongs to state or not? Can Union issue an ordinance of transferring some area from one state to another without considering two affected states?Better option in out case is asking for remains. At least we can get another chance. Bifurcation should not affect people, SC in EAMCET case, so it is duty of APPSC to conduct exam and successor states has to take them in 58:42.

Likit...what ever u said is correct...we should think about those who suffered with wrong key...they are 209 not 4000. Dont think that APPSc would have given some wrong number to court....no govt body can take such risk (especially with courts). Apart from these what i m trying to say is "two mains is not wrong why because somany exams in this days are happening with more than one set of papers(for the same job) due to various reasons. In our case mistake was done by APPSC not by Interviewed ones. We hav no role in wrong key issue. So our intrests should also be protected. "As per our indian law no innocent should be punished at any cost". Thats why mains for 209 is justifible.

Does APPSC have the right to cancel the notification? I mean does it have a legal or constitutional backing to this. Has it cancelled any notification in the past?

If we consider the two probable future actions of APPSC,

1) Filing a Curative petition.

2)Cancellation of notification.

These two courses of action will not go hand in hand, as such they do not denote contiguous line of thinking. Each action is antithetical to the other. Everything here on is a grey area. Everything is possible and our honorable SC and APPSC will quote some arcane administrative cum judicial and legal philosophy to reaffirm their final judgment

@likitcool, Keeping aside your reasons for a moment, there was no particular instruction nor directive from SC to PSC saying that the examination should not be cancelled. In that way, the PSC is well within its right to cancel the notification, if it wants.

@Sempli, I agree with ur point. Likit always makes illogical statements. PSC has never been interested in conducting the exam. Had it been really intended, then who stopped it in conducting the exam, irrespective of state bifurcation etc issues? It wudn't hv been so tough if u compare the situation at the time of last mains held in 2011. Had it really thought of deleting the 6 questions, then it wudn't hv sent the bulk, fake material evidence to UPSC/ It wud hv simply asked in Tribunal and hc to delete the questions. It didn't do so. We all know dat...Even now, it is projecting as if it is protecting our interests. That's bullshit. The curative petition will at least take 3 months to be served at the bench. By that time, TSPSC would come into picture. The posts would be divided as a result of the cancellation of notification. APPSC has full rights to do so. You guys are making this simple issue, a complex one. My dear frnds, Wht was the intention of psc behind going to SC? If it really had thought of hurrying up, then it wud hv waited for the hc judgment soon after the report of upsc was delivered. Another astonishing fact is that, APPSC has claimed Rs 80 lakhs from the Govt. against the expenditure for legal proceedings only in SC. What do u say, frnds??? I heard the news that the candidates hv been fighting from Tribunal to HC r going to file the Curative only to safeguard the interests of larger section of aspirants. Likit cool garu's observations have been always right in this case. But in this point, sempli nath garu's point is correct. Unless and until sc gives a order to appsc, appsc may cancel the notification. If sc says not to cancel, then appsc cannot cancel.

As it stands, it is either re-mains which has a probability of 80 percent or appsc can scrap the notification. There is nothing more to be said on this case.

As their petitions were denied, they r going to file Curative. Only a fool like u can say that SC has ordered for Re-Mains. It just rejected all the Review petitions and opined dat their judgment had nothing to be reviewed. Do u know hw Jus.Chalameswar reacted in SC when it was heard first? @Sampath, I never changed my word. I still stick on to wat I say. I already told that PSC is not intersted in conducting or declaring the results. But I wish it shud do so. I said both pros and cons of the exam. I already made it very clear that it's not the question of fresh mains or re-mains, rather we should think from the court's/petitioners' point of view. As far as the cancelation of exam is concerned, It is definitely going to happen, keeping in mind how psc behaves....
